Terms and conditions for shop applications

Please read through the following terms before filling out the application form and submitting your work.

Applications must be submitted online. Once restrictions are eased there will be opportunities to visit Black Swan Arts to meet and present to the selection team following your initial application. But for now, the process will be completed virtually.

You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.

Terms and conditions

  • Black Swan Arts requires exclusivity of your products within a 10 mile radius of Frome. This means we will be the only stockist of your product and you will not supply stock to any other outlets within 10 miles of Frome.
  • This work remains the property of the supplier (designer-maker/artist) and as such will be taken care of by Black Swan Arts.
  • Black Swan Arts have the right to sell the purchased work and set their own price.
  • Suppliers are expected to own the copyright on all designs. No plagiarism may be involved in any products on sale through Black Swan Arts.
  • Your items/products are supplied on a sale or return basis. Work that is not selling will be returned to the supplier.
  • Each supplier, once accepted, is allocated a code, which should be marked clearly on stock price tickets and at the top right hand side of each delivery note.
  • A delivery note should accompany all work.
  • Suppliers are required to give one month notice via email before collecting stock from Black Swan Arts.
  • A collection note will be provided with stock which is withdrawn from sale at any time, after notice is given
  • Suppliers are usually living in the South West of England, although all applications will be considered and/or guest makers will also be considered.
  • Black Swan Arts takes a commission of 40% of the retail price on work sold.
  • Suppliers are notified monthly by e-mail of sales made through the shop.
  • Suppliers are paid monthly by BACS on the 28th of the month following sales.
  • Please inform us if you are able to accept commissions or personalised orders.
  • Black Swan Arts is insured against fire, window replacement and for public liability.
  • Suppliers are advised to check with trading standards officers regarding legal requirements for the safety and labelling of food, drink, electrical items, toys and beauty products.
  • With the exception of those products required to do so by Trading Standards legislation, Black Swan Arts is not able to display suppliers’ contact details.
  • Black Swan Arts management will keep records of all deliveries and copies of delivery notes in the office on site.
  • Any queries regarding statements and payments should be made within one month by e-mail to shop@blackswanarts.org.uk
  • We provide a stock stake of your work up to four times a year on your behalf. After this an extra charge of £5 will be added to your monthly statement per extra stock check. Please email us to request a stock check giving one week’s notice.
